HR Consult (“HR Consult”, “we”, “us”, “our”) is a division of BEE Analyst. We place a high premium on the privacy of every person and organisation we deal with, and we are committed to processing your personal information lawfully and transparently in line with the Protection of Personal Information Act, 4 of 2013 (“POPIA”) and, where applicable, the General Data Protection Regulation (“GDPR”).
This policy explains what personal information we collect, why we collect it, how we use and protect it, who we share it with, and the rights you have. Because HR Consult is a division of BEE Analyst, your information may be shared within the BEE Analyst group of companies where this is necessary to deliver our services to you — for example, where a matter calls on BEE Analyst’s B-BBEE expertise. By using our website or services you accept the terms of this policy; acceptance is voluntary but is necessary to enable us to provide our website and services to you.
1. The information we collect
Depending on the service, the personal information we process may include:
- Full names and, where relevant, identity or company registration numbers
- Statutory and compliance information relevant to the service we provide
- Financial and banking information, where this is necessary to deliver or be paid for a service
- Physical and postal addresses
- Telephone numbers and email addresses
- Unique identifiers we allocate to you as a client or contact
We collect personal information:
- Directly from you — when you complete a form on our website, download a resource, email or call us, or engage us for a service
- Automatically — through cookies and similar technologies when you use our website (see section 4)
- In hard-copy or in person, during the course of our work with you
Where you give us the personal information of another person (for example an employee or colleague), you confirm that you are entitled to do so, and we will process that information in line with this policy.
2. How we use your information
We process personal information to:
- Provide, manage and administer our products and services, and our relationship with you
- Identify you and understand your needs, so we can advise and assist you
- Maintain accurate client, contact and supplier records
- Support employment, recruitment, skills-development and related administration where this forms part of a service we provide
- Meet our legal, contractual, health-and-safety and regulatory obligations
- Improve the quality of our services and our website
- Share information within the BEE Analyst group and with trusted third-party service providers, where necessary to deliver a service (see section 3)
- Carry out research and statistical analysis, on an anonymised basis where possible
- Recover any amounts owing to us
- Comply with applicable laws
We will not process your personal information for a purpose unrelated to those set out above unless you consent, or the law permits or requires us to.
Where we make use of automated processing to reach a decision that significantly affects you, you may object to or query the outcome of that decision.
3. When we share your information
We may disclose your personal information to third-party service providers (for example hosting, customer-relationship-management and email providers) and to companies within the BEE Analyst group, where this is necessary to achieve the purposes for which the information was collected. Where we do, we put written agreements in place requiring them to handle your information in line with POPIA and other applicable laws.
4. Cookies and our website
Our website uses cookies and similar technologies to make the site work, to remember your preferences, and to understand how the site is used so we can improve it. You can control or delete cookies through your browser settings; disabling some cookies may affect how the website functions.
5. Sending information outside South Africa
Some of our service providers may process or store personal information outside South Africa. Where this happens, we take reasonable steps to ensure the information is protected in line with POPIA, and we will obtain your consent where this is required. Personal information processed in another country may be subject to the laws of that country.
6. How we keep your information safe
We implement appropriate, reasonable physical, organisational, contractual and technological measures to protect the integrity and confidentiality of your personal information, and we restrict access to those who have a legitimate reason to use it. If a security compromise occurs, we will notify the Information Regulator and affected people as required by law, as soon as reasonably possible.
No method of transmitting or storing information is completely secure. While we take all reasonable measures to protect your information, we cannot guarantee that our systems are entirely secure, and any transmission of information to us is at your own risk.
7. How long we keep your information
We keep personal information only for as long as necessary to fulfil the purpose for which it was collected, or for as long as the law permits or requires. When it is no longer needed, we securely delete, destroy or anonymise it.
8. Keeping your information accurate
We take reasonable steps to keep your personal information accurate and up to date. Please let us know if any of your details change, or if you would like us to update, correct or delete information we hold about you.
9. Your rights
Subject to the limits allowed by law, you have the right to:
- Ask for a copy of the personal information we hold about you
- Ask us to correct or delete your personal information
- Object to the processing of your personal information, including for direct marketing
- Withdraw consent you have given, and object to or query a decision based solely on automated processing
- Lodge a complaint with us and, if not resolved, with the Information Regulator (see section 11)
You can exercise these rights by contacting us using the details in section 12. Formal requests for access to information are handled through our PAIA Manual.
10. Direct marketing
We will only contact you for direct-marketing purposes where POPIA (and the GDPR, where applicable) allows us to. Every marketing message gives you a simple way to opt out, and you can ask us to stop at any time by contacting us.
11. If you choose not to provide information
Where we need certain personal information by law or to deliver a service, and you choose not to provide it, we may be unable to provide that service — in which case we will let you know.
12. Access requests, PAIA and fees
You can request access to the personal information we hold about you, and challenge its accuracy or completeness, through the process set out in our PAIA Manual (published under section 51 of the Promotion of Access to Information Act, 2000). Any prescribed fees payable for copies of your information are listed in that manual.
13. Complaints to the Information Regulator
If you believe we have processed your personal information contrary to this policy, please raise it with us first at info@hrconsultsa.co.za so we can try to resolve it. You also have the right to lodge a complaint with the Information Regulator (South Africa):
